The Regional Labor Court of the 2nd Region (TRT-2) upheld the dismissal for just cause of a janitor who sent anonymous messages containing threats to residents of the condominium where he worked. The court found the conduct to be serious and sufficient to break the trust required to maintain the employment relationship.
According to the case files, the threatening messages caused fear and insecurity among the residents. The investigation during the proceedings revealed that the employee had used anonymous means to issue the threats, a behavior incompatible with his role and with the communal living environment.
In reviewing the case, the panel determined that the conduct constituted a serious breach, falling under the provisions of Article 482 of the Consolidation of Labor Laws (CLT), justifying dismissal for cause. The argument that the penalty was disproportionate was also rejected, given the impact of the threats on the condominium’s atmosphere.
Thus, the court upheld the decision that confirmed the termination of the employment contract for cause, resulting in the employee’s loss of entitlement to severance payments typically associated with dismissals without cause.
