STJ Rules That High-Market-Value Family Home Is Exempt from Seizure

The Superior Court of Justice (STJ) has ruled that a family home remains exempt from seizure, even when it has a high market value. The decision reinforces the legal protection granted by Law No. 8,009/90, which ensures the immunity from seizure of property used as a family residence.

According to the court, the property’s high value alone does not invalidate the legal protection, as long as it is used as the family’s primary residence. The Court emphasized that the law does not set a value limit for recognizing a family home, and that it is not permissible to undermine the rule based solely on economic criteria.

The STJ further stressed that allowing seizure in such cases would violate the fundamental right to housing and undermine the social purpose of the law, which is to ensure the dignity of the family unit regardless of its financial standing.

As a result, the property remains protected from seizure, and may not be used to satisfy the debt.
