Goiás Court Bars Bank from Recalculating Debt After Client Accepts Settlement Offer

The Court of Justice of Goiás (TJ-GO) ruled that a financial institution cannot recalculate the value of a debt after the client has formally accepted a settlement offer proposed by the bank itself. The court held that the acceptance creates a legal bond between the parties, and the originally agreed-upon terms must be honored.

According to the decision, any subsequent attempt to change amounts, charges, or conditions of the agreement violates the principles of objective good faith and legal certainty, and frustrates the legitimate expectations of the consumer who agreed to the offer as presented.

The court emphasized that, once the offer is accepted, the bank cannot unilaterally revise the debt, even if it claims internal error or the need for recalculation. Such conduct was deemed incompatible with the rules governing contractual and consumer relations.

As a result, the court ordered that the debt remain as outlined in the originally accepted agreement, blocking the recalculation sought by the financial institution.
