TRT-15 Upholds Dismissal for Just Cause of Worker Who Flipped Table and Assaulted Doctor

The 10th Panel of the Regional Labor Court of the 15th Region (TRT-15) upheld the dismissal for just cause of a worker who flipped a table and assaulted a doctor during a consultation that took place on the company’s premises. The panel found that the worker’s conduct constituted a serious offense, sufficient to break the trust essential for maintaining the employment relationship.

According to the case records, the incident involved an act of physical violence, a behavior deemed disproportionate and incompatible with the workplace environment. The decision emphasized that such actions violate fundamental duties of the employee, particularly civility, respect, and good faith, as established in labor legislation.

Upon reviewing the worker’s appeal, the 10th Panel concluded that the evidence presented in the case was sufficient to prove the severity of the conduct, ruling out the possibility of overturning the disciplinary action. As a result, the just cause dismissal was upheld, along with the consequent loss of severance entitlements normally granted in cases of dismissal without cause.
